Terms of Service

1. Acceptance of Terms
By accessing or using the SubSight website at subsight.ca, the SubSight mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
SubSight (“we,” “us,” or “our”) reserves the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance.
2. Description of Service
SubSight is a subscription management and bill negotiation platform that:
- Connects to your Canadian bank account (read-only) via Plaid to retrieve transaction data
- Uses AI (Google Gemini) to detect recurring subscriptions from your transactions
- Allows you to track and manage subscriptions manually or automatically
- Generates AI-powered cancellation emails for unwanted subscriptions (Premium)
- Analyzes bills for negotiation opportunities and generates negotiation emails (Premium)
- Makes AI-powered phone calls to service providers to negotiate lower rates on your behalf (Premium)
- Tracks negotiation progress and outcomes
3. Account Terms
To use the Service, you must:
- Be at least 18 years of age
- Be a resident of Canada
- Create an account using valid information through our authentication provider (Clerk)
- Maintain only one account per person
- Keep your account credentials secure and confidential
You are responsible for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for an extended period.
4. Free and Premium Plans
4.1 Free Plan
The free plan includes:
- Bank account connection via Plaid
- Subscription detection
- Subscription dashboard and tracking
- Manual subscription entry
4.2 Plus Plan ($7.99 CAD/month)
The Plus plan includes everything in the Free plan, plus:
- Unlimited AI subscription scans
- AI-generated cancellation emails
- Spending insights and analytics
4.3 Premium Plan ($14.99 CAD/month)
The Premium plan includes everything in the Plus plan, plus:
- AI bill negotiation analysis
- AI-generated negotiation emails
- AI phone negotiation — our AI agent calls providers to negotiate lower rates (see Section 9)
- Negotiation status tracking
- Priority support
5. Payment Terms
5.1 Subscription Fee
The Plus plan costs $7.99 CAD per month and the Premium plan costs $14.99 CAD per month. All prices are in Canadian dollars and include applicable taxes unless otherwise stated.
5.2 Free Trial
New Plus and Premium subscribers receive a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid monthly subscription.
5.3 Billing and Renewal
Payments are processed securely through Stripe. Your subscription will automatically renew each month on the anniversary of your subscription start date. You authorize us to charge your payment method on file for each renewal period.
5.4 Negotiation Commission
When SubSight successfully negotiates a lower rate on your behalf, a commission of 40% of the first year’s savings applies. For example, if we reduce your monthly bill by $20 (saving you $240/year), the commission would be $72 CAD. The commission is calculated and invoiced only after successful negotiation results are confirmed.
6. Cancellation and Refunds
6.1 Subscription Cancellation
You may cancel your Premium subscription at any time through the Settings page in the app. Upon cancellation:
- Your Premium features remain active until the end of your current billing period
- Your account will revert to the Free plan at the end of the billing period
- No further charges will be made
6.2 Refund Policy
Subscription fees are generally non-refundable. However, if you cancel within the 3-day free trial period, no charges apply. For billing errors or exceptional circumstances, contact [email protected] and we will review your request on a case-by-case basis.
6.3 Account Deletion
You may permanently delete your account and all associated data through the Settings page. Account deletion is immediate and irreversible. Any active Premium subscription will be cancelled, and no refund will be issued for the remaining billing period.
7. Bank Connection and Financial Data
By connecting your bank account through Plaid, you:
- Consent to SubSight receiving read-only access to your account information and transaction history
- Acknowledge that SubSight cannot and will not move, withdraw, or modify funds in your account
- Understand that your banking credentials are handled directly by Plaid and are never shared with SubSight
- May disconnect your bank account at any time through the app
SubSight is not a financial institution and does not provide financial advice. The information and analysis provided through the Service are for informational purposes only.
8. AI-Generated Content
SubSight uses Google Gemini AI to generate content including subscription detection results, cancellation emails, bill negotiation analysis, and negotiation emails. You acknowledge and agree that:
- AI-generated content is provided as suggestions only and should be reviewed before use
- AI-generated analysis may contain inaccuracies or errors
- You are solely responsible for reviewing, editing, and sending any AI-generated emails to service providers
- SubSight does not guarantee the accuracy, completeness, or effectiveness of AI-generated content
- SubSight does not guarantee that negotiations will result in savings
- AI-generated content does not constitute legal, financial, or professional advice
9. Bill Negotiation Authorization
9.1 Limited Power of Attorney
By using SubSight’s AI phone negotiation feature (available on the Premium plan), you grant SubSight a limited power of attorney to act as your authorized representative for the sole purpose of contacting your service providers to negotiate lower rates on your existing accounts. This authorization is limited to rate negotiations and does not extend to making plan changes, adding or removing services, accessing sensitive financial information, or any other account modifications.
9.2 Account Information
When you initiate an AI phone negotiation, you are required to provide accurate account details including your account number and the phone number on file with the provider. You may also provide optional verification information such as a security PIN or billing address. By providing this information, you:
- Confirm that you are the authorized account holder
- Consent to SubSight’s AI agent using this information to verify your identity with the provider
- Acknowledge that the AI agent will identify itself using your name and account details during the call
- Understand that calls may be recorded by the provider and/or by SubSight for quality assurance
9.3 Scope and Limitations
The authorization granted under this section:
- Is granted on a per-negotiation basis each time you initiate a call and confirm your consent
- Is limited to negotiating rate reductions on your existing service plan
- Does not authorize SubSight to agree to plan upgrades, service additions, contract extensions, or any changes other than rate reductions
- May be revoked at any time by cancelling the call or contacting support
- Does not guarantee any particular outcome — providers may decline to negotiate or may require additional verification
9.4 Commission on Successful Negotiations
If SubSight successfully negotiates a lower rate, a commission of 40% of the first year’s savings applies as described in Section 5.4. You will be notified of the outcome and any applicable commission before it is charged.
10. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Provide false or misleading information
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble the Service
- Use automated tools to scrape or access the Service
- Resell, redistribute, or commercially exploit the Service without authorization
- Interfere with or disrupt the Service’s operation
- Impersonate another person or entity
11. Intellectual Property
The Service, including its design, code, AI models (as used), logos, and content, is owned by SubSight and protected by Canadian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
AI-generated content produced for you (e.g., cancellation emails, negotiation emails) may be used by you for the purpose of managing your subscriptions and contacting service providers.
12. Limitation of Liability
To the maximum extent permitted by Canadian law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied
- SubSight shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- SubSight’s total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to SubSight in the 12 months preceding the claim
- SubSight is not responsible for any actions taken by service providers in response to cancellation or negotiation emails, whether AI-generated or otherwise
- SubSight does not guarantee any specific savings, negotiation outcomes, or subscription detection accuracy
13. Indemnification
You agree to indemnify and hold harmless SubSight, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your use of AI-generated content from the Service
- Any dispute between you and a third-party service provider
14. Third-Party Services
The Service integrates with third-party providers including Clerk (authentication), Plaid (banking), Stripe (payments), Google Gemini (AI), and Resend (email). Your use of these services is subject to their respective terms and privacy policies. SubSight is not responsible for the availability, accuracy, or conduct of third-party services.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the courts of competent jurisdiction in the Province of Quebec, Canada.
Nothing in these Terms limits your rights under the Consumer Protection Act (Quebec) or any other applicable consumer protection legislation.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SubSight regarding the Service and supersede all prior agreements and understandings.
